These terms govern use of websites and authorized online services operated by Energy Werx Corp., including access points for Mo(mentum).

Use of the websites

You may use public Energy Werx websites for lawful informational and service-related purposes. You must not interfere with site operation, attempt unauthorized access, introduce malicious code, or use the websites in a way that violates applicable law.

Mo(mentum) access

Mo(mentum) is available only to authorized users. Users are responsible for maintaining the confidentiality of their credentials and for activity performed through their account. Access may be suspended or revoked where necessary to protect customers, Energy Werx, participating business units, or connected services.

Information and program availability

Rebates, grants, incentive programs, eligibility rules, amounts, and timelines may change. Website information is general and does not guarantee eligibility, payment, approval, savings, or specific results.

Third-party services

Our websites may link to third-party websites or use third-party services, including Google and Firebase. Those services are governed by their own terms and privacy practices.

Intellectual property

Website content, branding, software, workflows, and related materials are owned by or licensed to Energy Werx Corp. They may not be copied, distributed, reverse engineered, or commercially reused without written permission, except as permitted by law.

Disclaimer

The websites and services are provided on an “as available” basis. To the extent permitted by law, Energy Werx disclaims warranties not expressly stated in a written agreement.

Limitation of liability

To the extent permitted by law, Energy Werx is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the websites or online services.

Changes

We may update these terms as services, legal requirements, or business practices change. The latest version will be posted on this page with an updated effective date.

Terms of Service

1. Acceptance of Terms

These Terms of Service govern access to and use of Mo by Energy Werx and related Energy Werx websites, applications, and services.

By accessing or using Mo, you agree to comply with these Terms and any additional policies, agreements, or instructions that apply to your role or business relationship with Energy Werx Corp.

2. Authorized Use

Mo is intended for authorized Energy Werx employees, contractors, advisors, administrators, affiliated business units, and approved business partners.

Users may access Mo only for legitimate and authorized business purposes related to Energy Werx operations, customer service, scheduling, energy evaluations, reporting, communications, work orders, invoicing, and administration.

3. User Accounts

Users are responsible for:

  • Providing accurate account information.
  • Keeping login credentials secure.
  • Preventing unauthorized access to their account.
  • Promptly notifying Energy Werx of suspected unauthorized access or security concerns.
  • Ensuring that activity performed through their account complies with these Terms.

Accounts may not be shared unless expressly authorized by Energy Werx.

4. Google Calendar Integration

Mo may allow a user to connect a Google Calendar account. By connecting Google Calendar, the user authorizes Mo to use the permissions presented during the Google authorization process.

Calendar access may be used to read availability, help prevent scheduling conflicts, and create, update, or remove calendar events associated with Mo appointments.

Users are responsible for connecting only Google accounts and calendars they are authorized to use.

5. Acceptable Use

Users must not:

  • Access information they are not authorized to view.
  • Use Mo for unlawful, fraudulent, or misleading purposes.
  • Attempt to bypass security, permissions, authentication, or access controls.
  • Interfere with the availability, security, or performance of the platform.
  • Upload malicious code, viruses, or harmful materials.
  • Copy, reverse engineer, resell, distribute, or commercially exploit Mo without written authorization.
  • Use information from Mo for unauthorized marketing or solicitation.

6. Customer and Business Information

Users must handle customer, homeowner, employee, contractor, and business information responsibly and only for authorized purposes.

Users remain responsible for the accuracy and appropriateness of information they enter, update, upload, send, or manage through Mo.

7. Availability and Changes

Energy Werx may update, modify, improve, suspend, or discontinue features of Mo at any time.

While Energy Werx works to maintain reliable service, continuous or uninterrupted availability is not guaranteed.

8. Intellectual Property

Mo by Energy Werx, its software, workflows, interface, branding, documentation, content, and related intellectual property are owned by or licensed to Energy Werx Corp.

No ownership rights are transferred to users through access to the platform.

9. Suspension or Termination

Energy Werx may restrict, suspend, or terminate access where a user:

  • Violates these Terms.
  • No longer has an authorized business relationship.
  • Creates a security or privacy risk.
  • Misuses the platform or information contained within it.
  • Is required to be removed for legal or operational reasons.

10. Disclaimer

Mo is provided for business and operational support. Energy Werx does not guarantee that all content, calculations, availability information, integrations, or automated outputs will always be complete, current, or error-free.

Users are responsible for reviewing important business, scheduling, customer, financial, and program information before relying on it.

11. Limitation of Liability

To the extent permitted by applicable law, Energy Werx will not be liable for indirect, incidental, special, consequential, or punitive damages resulting from use of or inability to use Mo.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

13. Changes to These Terms

Energy Werx may update these Terms periodically. Continued use of Mo after updated Terms are published constitutes acceptance of the revised Terms.
